2. NOTIFICATIONS AND NEWSLETTER
By providing Chaac with your email address, you agree that we may use your email address to send you notifications about the status of your order. We will also send you important communications about our products, promotions, news and special content. If you do not wish to receive these communications, you can opt out of receiving them through our contact page or by using the ‘unsubscribe’ option in the emails.
3. ORDERS
By placing an order, you agree to purchase the products at the price indicated on our website at the time of placing the order. It is important that you review the full product description and specifications before confirming your order to ensure that it meets your expectations and needs.
Once you place an order, Chaac will automatically send you a confirmation email. This email is intended to provide you with a record of your purchase and the details of your order, including confirmation of payment.
We reserve the right to limit the number of units that each user can purchase. In addition, Chaac reserves the right to restrict the sale of our products in certain regions or jurisdictions.
Chaac reserves the right to cancel any order, as well as to modify or discontinue the availability of products at any time, at its sole discretion. If an order is cancelled by Chaac, any related payments made will be refunded in full.
Each order is considered and processed individually, and is treated separately from any previous or subsequent orders.
4. ACCURACY OF INFORMATION
When ordering, the customer is responsible for providing accurate information that is sufficiently detailed and up-to-date. Customers will be responsible for any delays, losses, damages and additional costs resulting from incorrect or outdated information.
5. PRODUCT INFORMATION AND PRICES
Product information and prices will be available on each product page of the website. Product prices are valid for the period during which they appear on the website.
Chaac reserves the right to determine the price of the products and these may be subject to change at any time without notice.
We will always try to keep the prices on the website accurate. However, from time to time pricing errors may occur, including but not limited to human, mechanical or similar errors. If a pricing error is discovered, the customer will be informed of the error and will have the option to reconfirm the order at the correct price. The user will also have the option to cancel the order.
Products may differ slightly from the images shown on our website, as these are used for illustrative purposes only. While we strive to represent colors accurately, we cannot guarantee that the display on your device will exactly match the actual colors of the products.
Chaac attempts to be as accurate as possible. However, Chaac does not warrant that product descriptions, product prices or other content of this website is accurate, complete, reliable, current, or error-free.
All product offers displayed on the website are for information purposes only and Chaac is not obliged to enter into a purchase agreement in relation to these products, including if the products are not available.
6. PAYMENTS
Customers can pay for the products using the following payment methods:

The customer must pay the price of the product stipulated in the order before the product is shipped. Payment will be charged to the payment method selected by the customer at the time of placing the order.
Once the transaction has been processed, we will send an electronic receipt of the transaction to the customer's email address. If you find any inconsistency in your billing, please contact us through our contact page or you can make the claim through the customer service of the corresponding payment processor.
If your card is declined, you will receive an error message. No payment will be charged to your card and no order will be processed. There may be a pending transaction on your account until your card-issuing bank withdraws the authorization. This usually takes 2 to 5 business days. Your card may be declined for various reasons, such as insufficient funds, AVS (Address Verification System) mismatch or entering an incorrect security code.
If your payment is declined, you must provide an alternative payment method or provide another card where payment can be charged and processed.
Your payment information will be safeguarded and will be used for the exclusive purpose of processing the purchase of the products. Chaac reserves the right to contract with any payment processor.
7. PROMOTIONS AND SWEEPSTAKES
From time to time Chaac may present customers with bonuses, sweepstakes or other promotions. Prizes and other benefits received in connection with a promotion may not be transferred, assigned, sold, swapped or bartered.
If we provide any prize or other benefit, it is provided on an “as is” basis without any warranties by us, including any warranty of merchantability or fitness for a particular purpose.
Chaac may at any time change, cancel or restrict the availability of promotions and benefits.
Any person who Chac reasonably believes has tampered or attempted to tamper with any promotion shall be disqualified from participating.
By participating in a promotion, you agree to abide by the decisions made by the organizers. All such decisions are final. If any promotion is not permitted or is limited by the laws of any jurisdiction, the promotion will not be valid in such jurisdiction.
You shall enter into any promotion at your own risk, and you will not be able to claim any loss or damage in relation to your participation in the promotion or receipt of any benefit.
8. LIMITED WARRANTY
Our products are subject to the following limited warranty:
We warrant to the purchaser of our product that, for a period of six (6) months after the date of purchase, our product will be free from defects in materials or workmanship and shall perform in accordance with the product specifications. If you believe the product your purchased is defective or does not perform according to specifications, you may return the product to us, post-marked within the one-year period, properly packaged with shipment prepaid. If we confirm the returned product is covered by this warranty, we may, at our discretion, refund the purchase price, repair the product, or send you a new product. In the event a product covered by this warranty is returned to us, all shipping costs will be paid by us.
This warranty does not apply in case of damage caused by mishandling, the environment, or failure to operate or maintain the product in accordance with the instructions furnished with the Product. The warranty also does apply if the security sticker affixed to the product preventing access to its internal parts is torn or removed.
This warranty extends only to the original purchaser of the product and is not transferable.
9. LIMITATION OF LIABILITY AND DISCLAIMER OF WARRANTIES
Chaac, as a provider of consumer products, limits its liability to the maximum extent permitted by applicable law. The client acknowledges that the products are sold and the website and the mobile app are provided “as is” and “subject to availability”, and that Chaac makes no warranty, express or implied, as to the suitability, operation, compatibility, performance or fitness of the products, the website or the mobile app for a particular purpose, except in cases where such warranties are expressly stipulated in the product description or specifications.
Chaac makes no promise that use of the website or the mobile app will be uninterrupted or error free. We will not be liable to you if we are unable to provide the website or the mobile app or for any damages incurred by you in connection with your use of the website or the mobile app. Our website may from time to time contain links to other websites which are not under the control of and are not maintained by us. These links are provided for your convenience only and we are not responsible for the content of those sites.
The client assumes sole responsibility for the selection, installation and use of the products purchased, as well as for the results obtained from their use. Chaac shall not be liable for any direct, indirect, incidental, special, punitive or consequential damages that may arise from the use of the products, the website or the mobile app. This includes, but is not limited to, economic losses, operational interruptions, damage to equipment or property, loss of data or any other damage derived from the use of the products, the website or the mobile app.
Chaac shall not be liable for delays in delivery, supply failures or contractual breaches arising from causes beyond its reasonable control, such as, but not limited to, natural disasters, labor disputes, supply chain disruptions, government restrictions, technological system failures or any other force majeure event. In such circumstances, Chaac may adjust delivery times or modify its contractual obligations as necessary.
The client acknowledges that any technical advice or information provided by Chaac, whether through its personnel, promotional material or any other means, is for information purposes only and does not constitute any warranty, commitment or liability whatsoever with respect to the use or performance of the products purchased. The client is responsible for obtaining the necessary professional advice before using the products in specific applications.
Chaac's total liability in any circumstances will be limited to the amount actually paid by the customer for the product in question. Under no circumstances will Chaac assume any additional obligations or be liable for compensation, indemnity or any type of damage that exceeds said amount. By accepting these terms and conditions, the customer acknowledges and agrees to the limits of liability established in this clause.
10. COPYRIGHT
All materials on the website, including, without limitation, names, logos, trademarks, images, text, columns, graphics, videos, photographs, illustrations, software and other elements are protected by copyrights, trademarks and/or other intellectual property rights owned by Chaac or by third parties that have licensed or otherwise provided their material to the website. You acknowledge and agree that all material on the website is made available for limited, non-commercial, personal use only and for the sole purpose of viewing the contents of the website and purchasing products. No material may be copied, reproduced, republished, sold, downloaded, posted, transmitted, or distributed in any way, or otherwise used for any other purpose, by any person or entity, without Chaac’s prior express written permission. Any dispute, claim or controversy arising in connection with the interpretation, application or execution of these terms and conditions, as well as any transaction made on the Chaac website, shall be initially resolved through good faith mediation administered by the American Arbitration Association under its Commercial Mediation Procedures. The mediation will be conducted confidentially in Los Angeles, California.
If the parties fail to resolve the dispute within 30 days after the start of mediation, the dispute shall be submitted to binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules before a single arbitrator in Los Angeles, California. Any decision or arbitral award shall be final and binding on both parties, and shall be enforceable in any court with competent jurisdiction.

These terms and conditions shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflicts of law rules.
19. FINAL PROVISIONS
